These Terms of Service govern purchases from and use of the VirtuGather online store. By placing an order, you agree to these Terms together with our Privacy Policy, Refund Policy and other policies displayed on our website. Nothing in these Terms limits any consumer rights that cannot legally be excluded.

2. Digital products

VirtuGather sells digital planning systems, workbooks, templates and related downloadable content.

Unless a product page specifically states otherwise, all products sold by VirtuGather are digital products. No physical item will be shipped.

Each product page describes what is included, the applicable file format and the intended use of the product.

3. Orders and payment

All prices displayed at checkout are the prices applicable to your order, including taxes where Shopify displays them as included.

Payment must be successfully authorised before access to digital content is provided.

VirtuGather reserves the right to cancel or refuse an order where reasonably necessary because of suspected fraud, a payment failure, a pricing or technical error, or a legal or regulatory requirement.

4. Digital delivery

Digital products are delivered electronically following successful payment.

Customers are responsible for providing a valid and accessible email address during checkout.

Where automatic digital fulfilment applies, access to the purchased files will normally be provided through Shopify's digital-delivery system following completion of the order.

If you do not receive your download or experience difficulty accessing it, contact us using the details above and include your order number.

5. Licence and permitted use

Unless otherwise stated on the product page, purchasing a VirtuGather digital product gives you a non-exclusive, non-transferable licence to use the purchased material for your own personal or internal business use.

You may print working copies for your own permitted use.

You may not:

resell or redistribute the files;

upload the files for public access;

sublicense the product;

reproduce the product for commercial resale;

share the original files as a standalone product;

remove branding and represent the content as your own work.

6. Intellectual property

All intellectual property rights in VirtuGather products, original text, layouts, templates, branding and associated materials remain with VirtuGather or the relevant rights holder.

Purchasing a product gives you permission to use it under these Terms. It does not transfer ownership of the underlying intellectual property.

7. Refunds, cancellation and consumer rights

Refund and cancellation requests are governed by our Refund Policy and applicable consumer law.

Nothing in these Terms removes or restricts rights that cannot legally be excluded, including rights that may apply where digital content is faulty, inaccessible or does not conform to the contract.

8. Technical requirements

You are responsible for having a suitable device and software capable of opening the file formats stated on the product page.

The VirtuGather Virtual Event Planning System is supplied as a PDF and requires a standard PDF-compatible reader.

9. Accuracy of information

We aim to ensure that product descriptions, prices and store information are accurate.

If a material error affects an order, we may take reasonable steps to correct it and will provide any remedy required by applicable law.

10. Use of our products

VirtuGather products are planning and organisational tools. Results depend on how the purchaser uses and implements the material.

We do not guarantee any particular commercial, financial, attendance, marketing or event outcome from use of our products.

Nothing in this section limits liability where doing so would be unlawful.

11. Changes to these Terms

We may update these Terms periodically.

The Terms applicable to a purchase are those made available when the order is placed, except where changes are required by law.

These Terms are governed by the laws of Ireland.

If you are a consumer, this does not remove any mandatory consumer protections that apply to you under applicable law.
