Digital Products, Cancellations and Refunds

VirtuGather sells downloadable digital content. No physical goods are shipped.

YOUR STATUTORY RIGHTS

Nothing in this policy limits or excludes any mandatory consumer rights that apply to you.

If you are a consumer, you may have statutory rights relating to cancellation, withdrawal, conformity, refunds, price reductions or other remedies under the laws that apply to you.

CANCELLATION AND WITHDRAWAL

For qualifying online consumer purchases, including purchases by consumers in the European Union and European Economic Area, a statutory withdrawal period may apply.

For digital content that is not supplied on a physical medium, the withdrawal period is generally 14 days from the date the contract is concluded.

However, where permitted by law, the statutory withdrawal right may end once supply of the digital content begins if:

• you gave prior express consent for the supply of the digital content to begin during the withdrawal period;

• you acknowledged that beginning supply would result in the loss of your right of withdrawal; and

• the required confirmation of your consent and acknowledgement was provided to you.

If these requirements have not been satisfied, your statutory withdrawal rights remain unaffected.

If a statutory cancellation or withdrawal right applies, you may notify VirtuGather using the contact details below or through any electronic withdrawal or cancellation function made available on our store.

Where applicable law gives you an unconditional right of withdrawal, you do not need to provide a reason for cancelling.

FAULTY, INACCESSIBLE OR MISDESCRIBED DIGITAL CONTENT

If your digital product cannot be accessed, is materially faulty, corrupted, incomplete or does not match the description provided on the product page, please contact us with:

• your order number; and
• the email address used at checkout.

We will first try to resolve the issue promptly, including by restoring access or supplying a working copy where appropriate.

If the issue cannot be resolved, we will provide any refund, price reduction or other remedy required by applicable law.

CHANGE-OF-MIND REQUESTS

Where no statutory cancellation or withdrawal right applies, or where that right has validly ended in accordance with applicable law, change-of-mind refunds are not generally offered after correctly supplied digital content has been delivered.

This does not affect your statutory rights in relation to digital content that is faulty, inaccessible, misdescribed or otherwise does not conform to the contract.

DUPLICATE PURCHASES

If you accidentally purchase the same VirtuGather digital product more than once, please contact us as soon as possible and provide both order numbers.

We will review the transactions and, where appropriate, refund the duplicate purchase.

REFUND TIMING

Where a refund is legally due following a cancellation, withdrawal or other valid claim, it will be processed within the period required by applicable law.

Where applicable, refunds will normally be returned using the same payment method used for the original transaction unless another method is expressly agreed.

DIGITAL DELIVERY

VirtuGather products are supplied electronically.

After successful payment and order processing, your purchased digital files are made available electronically using the email address provided at checkout.

If you complete payment but do not receive access to your files, please check your spam or junk folder and then contact us.
